TERMINATION OF MARRIAGE

A divorce can be either contested or simplified.

Simplified divorces are settled out of court. They cost less than a contested divorce and can be finalised within 4-6 months.

  1. Fix an appointment at our office to give instructions
  2. Preparation of divorce documents (2-3 weeks)
  3. Sign divorce documents
  4. Simplified Divorce Hearing 4-6 weeks later (Attendance dispensed with)
  5. Interim Judgment granted
  6. Certificate of Final Judgment extracted 3 months after Interim Judgment

DIVORCE PROCESS

+ You have to be married for at least 3 years before you can be granted a divorce in Singapore. 
If you have been married for less than 3 years, you may ask the Family Justice Courts for permission to file for a divorce. However, this is only granted under certain circumstances. E.g. physical / mental abuse. You can also consider filing for annulment. 
 
+ You or your spouse must have lived in Singapore for at least 3 years before you can commence divorce proceedings in Singapore. 

At least one party has to be a Singapore Citizen or be habitually resident in Singapore for at least 3 years preceding the filing of the writ. 

 
+ Do I need a Deed of Separation before I file for a divorce?

No, it is not needed. A Deed of Separation is a legally binding document between a married couple that states their mutual decision to live separately without changing the legal state of their marriage. It states the date that the parties have been separated and the agreed terms and ancillary issues pertaining to the separation. For example: 

  • Child custody and care for children of the marriage 
  • Division of matrimonial assets
  • Maintenance (alimony) for the wife and children
 
+ If you have children below the age of 21, you and your spouse are required to attend the Mandatory Co-Parenting Programme (CPP) before filing for divorce
Attendance of the CPP is a pre-requisite for filing of all divorce proceedings (simplified/contested).
